What EMPLOYEES need to know about the Smoke-Free Ontario Act

Employees are not allowed to smoke in any enclosed workplace, including workplace vehicles. Employees caught smoking in an enclosed workplace could be subject to internal disciplinary action as well as possible charges and fines (if found guilty) under the Smoke-Free Ontario (SFO) Act. 

Employees do have whistle-blower protection under the SFO Act including:

  • An employer may not dismiss, threaten to dismiss, discipline, suspend, penalize, intimidate or coerce an employee who obeys or seeks compliance with the act.
  • If an employee experiences any of the above-noted actions by his or her employer, the employee may direct complaints to the Ontario Labour Relations Board. 
     

Employees who wish to report smoking in an enclosed workplace or enclosed public place can contact theTobacco Hotline at 519-258-2146, ext. 3218 or through email at tobacco@wechealthunit.org. Calls can be made anonymously but for those who wish to provide their name, the Health Unit will not release any information about their identity. Tobacco enforcement staff will investigate all complaints received through the Tobacco Hotline.
